I was thinking the same thing. Beating the shite out of people in school has always been "against the rules" but eventually bullies get what they deserve (e.g. some kid snaps and beats the ever living hell out of him on the school bus or something). It is the parents' job to stand up for their kids actions, especially after alerting the school to the bullying multiple times.
Anyway, if the bully is still in school, your kid will be there too after he beats the shite out of said bully. Tell him it's OK.

The only solution is to contact the dad and set up a tag team match.
You and your boy versus the bully and his dad.
No holds barred, winner takes all.

Reminds me of a great memory I have of my brother.
We were never big kids, to put it mildly. Anyway - some a-hole was picking on me on the playground; I was giving up a good three years and fifty pounds, so fear was a big element in taking it a bit more grief than I should. My bro could see I was getting upset, so he tells me the next time this frick did anything, to hit him in the face -- pointing to his buddies, he tells me, "we got your back."
So it happens, I call the kid a fat frick, and pop him in the jaw with all I had, which wasn't much - he just stands there looking at me.
After a split second, he comes at me, taking me down -- and then it was like a gang initiation for this poor frick; my brother and his boys all just bull-rushed him and kicked the shite out of him. Nobody on that playground ever fricked with me again and he got into trouble for picking on smaller kids, since we all told the teachers he charged me and that they were protecting me.
