As long as you don't know, and only you know. Plenty of first year associates can get you outta that one.

Your guilty.....if no fence and basically the same field you will get a ticket.....even if you didn't know about it.

And you wonder why you don't have any friends.

if you are within the zone of influence of the bait, lawdog can cite you.

bird cases are typically heard by the magistrate, many times a person with zero experience hunting. Scienter not required, and a violation that you had no idea was occurring can still get you convicted.

. It was 20 yrs ago and I still remember it. Joe was a piece of work. [/quote]
no, not a piece of work, a total freak a-hole that would cross the "sanity line of humanness" on doing his job.

we had a neighbor to the south who was constantly baiting. One year the birds were fast and furious in the corner of the parture by his fence. I shot a limit, and the last bird fell across the fence on his side. Left my gun and walked over there to pick it up. Wehat was scattered all over the gorund on his side. GTFO of there.
Later scouting found good numbers along the Red River behind the pasture. Set up before daylight, heard an outboard motor coming upriver. While we were standing there in the predawn, law dog snuck up into the willows and set up to catch the guy. We eased on out of there and hunted in the front.
Whether you bait or not, you can get busted, and they are typically unforgiving.

I hunted a field once that was later deemed to have been baited by GJ. They showed up at 2pm on opening day and checked everybody like a routine inspection. after they announced that the field was shut down. They had the property owner/hunter and threatened to write all 30 people a ticket if he didnt write a statement confessing to have baited the field. He basically told them to get to writing because he wasnt admitting to a thing. He got a citation for hunting over bait and everyone else was left unticketed.
From this experience id believe that if a neighbor is baiting and you're hunting your property they wont ticket you but may come shut it down.
