I hope never. But the Mayor is in a bad situation. He's White. Not sure that there is anything that can be done to make this into a hate crime.
If the mayor pushes it, and the police chief refuses.. then what? Have him removed? If that happens, he has an issue.
The only 2 ways I see:
1- The PC decides on his on to call it that.
2- the white people decide it's not worth having a racial fight.
