IF, and I say if, the very large and angry man (that had already struggled with the officer and went for his gun (if the gun went off in the vehicle there will be evidence) was angrily moving towards the officer and failed to halt when ordered, then it is NOT undeniable, but rather probable that he was a threat to the officer.
