If you shoot a guy after he jumps off a building (without a parachute and with nothing but pavement below him and with intent to kill himself) but before he hits the pavement and the coroner rules the death was caused by the bullet - its murder.
If you shoot a guy in his sleep with intent to kill him but it turns out he wasn't asleep but already dead when you shot him - its attempted murder.
