He has to warranty it, but he should be able to fall back on the fixture manufacturer warranty. But I do get your point as well. There is negligence on the builder/subs sometimes that causes fixtures to break that's not covered under manufacturer warranty. To a point, yes, a change in fixture shouldn't cause the price to increase past the cost but on occasions where a planned $400 chandelier turns into an antique found somewhere or a $1200 one out of that magazine the wife fell in love with - the builder is assuming more risk.
ETA: Customers who use the "you are doing the same work, why should your markup increase" line would balk if they chose cheaper fixtures to save money yet the builder kept his fee the same.

Speaking from experience, I wouldn't waste my time unless like you said it was something stupidly expensive. I would just replace it out of my pocket and move on so that my clients were happy instead if making them wait for the manufacturers warranty which can be a long time. I have done so in the past.
It's just the cost of doing business sometimes but there is no way I would have done it if someone said "here is $10K. I expect you to spend months building me a house and I also fully expect you to cover it in accordance with all Louisiana codes and laws no matter how expensive the items I pick out to go in it are."
I would tell someone in that case that I am not the builder they need and good luck.

Cant disagree with you.
At 9%, not wanting the guy to markup changes is expecting a little too much when you're already getting a great deal. If I was the OP I wouldn't question that deal. If you know the guy, and know he's a good builder, run with that. You won't beat it.
