Agree 100%, I wish this case and ruling were based on an employer's rights to structure a benefits package without government interference...

Obviously the answer is that the government imposing itself in the employer-employee contractual relationship is unacceptable. The problem is the idea that government gets to regulate the terms of an employment contract, not who gets what exception.
