If taken to court and questioned on the rules, YES. He would.
Attorneys will bring up the age of the NBA, the history of punishments, and the by laws. Then ask him why his punishment was harsher than all of the history. What was done by Sterling that was worse than Kobe. Why did he not act against an Owner who posted PUBLICLY pictures making fun of a guy with a disease?
There is noway Silver gets out of questions like that. He, in the least, will have to explain his punishments VS past history and vs the Shaq issue where nothing was even done.
All in all, this will paint the NBA as going after an old man because others wanted his team. It will be painted as strictly money is all that matters. That the NBA isn't really concerned about racial issues, about LGBT...

You should volunteer for jury duty sometime. I think you'll be disappointed what the rules of evidence actually allows. A 2L straight out of evidence is going to be able to successfully object against most of what your wanting to hear on the grounds of irrelevance and speculation.

No way around it? Do you think you can introduce any evidence in any court room? And there's no way around it? Do you even know the laws of evidence? Do you know the rules against hearsay? Do you know rule 401? The balancing test of 403?
