Scruffy, it's amazing how many people can't comprehend the difference between this story and protecting yourself/family from a break in.
Now, that doesn't negate the wrongful act of breaking in, but the break in does not give a person the right to do what he did.

Ok, hypothetical:
A hear someone break into my house in the middle of the night and I shoot them. In my state of adrenaline overdose, I say something smart arse to them and deliver a kill shot.
Did I commit 1st degree murder in this hypothetical?
