Yes. I think that is where everyone is getting confused. If you have already started your turn then someone tries to pass and slams into the side of your vehicle. The passing vehicle would be at fault.
If someone is passing you and you turn into the side of the passing vehicle then the turning vehicle is at fault.
If someone is passing you and you turn into the side of the passing vehicle then the turning vehicle is at fault.

Just talked to my brother who works in insurance.
Basically stated that it really depends on the impact area.
If the impatient driver hits the car turning in the rear, then the Impatient Driver is at fault.
If the point of impact is in the front or middle of the car, then the fault is on the person turning.
