Navigable is the word that gets a lot of folks in trouble here in Louisiana. That is the debate that has been going on between landowners and fishermen along the coast. Under Louisiana law, just because one can "navigate" a water body does not give the public the right to go upon private property.

All running waters are public, navigable or not. Unless its water made with private funds. Then it's private.

So to answer the question...no the pond is not running water. However, if it is classified as a lake (not a privately dug pond) you're good to go. Lakes are public.
