Im sure because it was a "Donation" that nothing can be done, but on the slim chance, could he be sued for obtaining money under false pretenses???

I don't think so since he printed the copies and made at least SOME attempt to mail them. I think any lawsuit would be more along the lines of breaking a contract (people paid for a certain service/product but did not receive it). I don't know that contract law has gone into the Kickstarter realm yet, so this may be new ground.
