This is what most likely happened, he appealed knowing he would be denied, but if he can proved that the ruling took too long he can go to court and argue that his due process was violated. A court can rule that he is entitled to back pay. Most cities would rather pay a cop for a couple of years than continue to run up legal bills not knowing the outcome.

Example an NOPD cop while on duty started drinking whiskey, took a dozen prescription pills then opened fire on his personal car. He shot more than 20 rounds into his car. NOPD responded thinking he was in a gun battle only to find him wasted talking about suicide. He was charged and pled no contest. But his termination violated the 'Police Bill of Rights'

Did you guys read the link? His conviction was for a pretty messed up situation. If he wasn't a cop, the OT would be discussing this one.

He was dating a 21 year old. OT would approve.

Him and said girlfriend want to have a threesome. OT would approve.

Said girlfriend says she will go out and bring a girl home. OT is now on its feet cheering for this guy.

Girlfriend picks up 16 year old, feeds her vodka and instructs her to tell boyfriend she is a "18 year old LSU student." Uh Oh. This isn't going to end well.

She brings drunk girl home and threesome ensues. If it wasn't for the previous paragraph, OT would be happy.

Guy is subsequently charged with Rape but it is bumped down to Carnal Knowledge. If he wasn't a cop, OT would be questioning his guilt and wanting to know why girlfriend isn't the one to burn on this.

Not defending the guy because he was a cop so stow that crap. Just saying, this is a little more complicated than a school teacher banging a student that they know to be underage.
