If an Independent is in the final top 4 they are in for sure. If they are not and there are only 3 conference winners ahead of them, I'd think you have to go with the Indy, though I get that causes some controversy (no system will be controversy free). The only time this came up was 2005 with Notre Dame being #6 ahead of #7 conference champ UGA, but behind tOSU and Oregon who did not win their conference. Oregon's only loss was 45-13 to #1 USC. ND also lost to USC (the famous Bush push game) and Mich State, both by 3.
