Martin may have been inspired to create a world by Tolkien but that's like saying that Kurt Cobain ripped off Mozart because they both played music.

There's a lot of differences, but Martin was inspired by Tolkien, even though they both have completely different takes on their fantasy universes. Both are very complete universes and there are certain fantasy elements; LOTR you have elves, GoT has White Walkers, dragons, etc. ASOIAF/Got=lots of grey characters; LOTR: you're either good or evil.
