Because legally there is a difference. They mandate that they wear thigh and knee pads now, which is a good change, but they don't mandate what kind they wear. If they start mandating which helmets they can wear then they open themselves up for more lawsuits. What if a player switches then gets a head injury that he never got before? They rely on NOCSAE for testing and certification and as long as they continue to pass them they will allow them.

...but they don't require the knee pads cover the knee (Rule 1-4-4d). A lot of players are wearing long biking shorts.
