re: A nobody poster asking a legal question

Having under a 0.08 BAC doesn't automatically mean you don't get a DUI.

Right. frick all the money and headaches. Hell 08 or not I deserve that much for driving on 3 hrs of sleep after drinking all night. Off my record is what I'd like if it is incorrect.

Dude, if it was your 1st and only dui you could have gotten deferred prosecution and it would be off your record.

Most municipalities offer defferred prosecution for 1st time offenders. Basically, a free pass.

SPEEDY would have reduced that to an inspection sticker and seat belt violation if paid in cash on the spot.

I feel like the camera showing my roadside test would go a long way if those blood results did not say what was presented in court. This isn't just the bac test. You may be right. That may make it all irrelevant

Not in TN. On your record for life. No way to EVER have it removed. The way it should be imo.

How, if possible, would one be able to look at test results after the fact. Who to ask, I guess.

Have an attorney file a motion for discovery.

ETA: if you already been to court, you fricked up.

I have now learned that this trooper was caught lying about these results in a DUI case.

that sounds like some post conviction relief possibilities, but i don't know how Tenn does that

not if no one saw it, as in a judge or jury, did you just plead guilty without putting up a fight?

Did you plead out or get convicted after a trial?

Yea a lot of this will depend on whether he just plead guilty or not. If you knowingly and voluntarily plead guilty, you might have a hard time fighting this over bac results.

Plus, pretty sure most police departments erase their dash cams after 3 or 4 weeks if no discovery is asked. And there is no guarantee the dash cam was even on.

tape's probably history by now, but if this cop has a reputation or record of impropriety, the local defense lawyers will know
