You can legally lift you leg and still throw to second.
You can legally lift your leg and still throw to third.

You cannot legally lift your leg and still throw to first.

You can argue the logic behind that all you want but those are the rules to a balk. That is a reason why a lot of analysts that announce games want the move to be declared a balk.
