Brent is not in anyway responsible for Browns death. Brown is responsible for his own death by getting in the vehicle with him. Brent should be punished for the only crime he committed, that being a second offense DUI. Brent did not make Brown get in the vehicle, Brown made that mistake on his own. There are no victims in the situation other than Brown's family.
