The criteria for 2nd degree battery requires serious bodily injury. If JJ kicked someone in the head, and that person didn't receive a serious injury as a result, then it can't be 2nd degree battery.

Kicking with a shoe would have been an aggravated battery, with more serious consequences than a simple battery.
