What privacy if I send someone a confidential file that is for them only. Plus, they have services that track how many times an email is open and for how long such as constant contact, etc.

Yes, but you are basically wanting access to another companies email server, which will never happen. Make them sign an NDA if you are so nervous, then you can sue them if they pass it on
