Because you strongly implied that the issue was the leverage she was exerting given her position. That is what you said "was that simple. And yes, it should be illegal." That's also why you're being pedantic about her employment status.
But it's not, is it?
It's because she had sex with the guy. Not because she exerted leverage (which she almost certainly did not have to do).
Let's admit that first. Then we can get back to what about that in this case warrants prison time.
