Depends on where the money comes from and how you classify it. If it is campaign funds, that would be the misuse of tax free campaign money for a personal expense. If it is business funds written off as a business expense, that would be a tax avoidance crime.

If one pays hush money with their own funds, it isn't a crime. The criminal aspect has everything to do with the tax laws or the campaign finance laws.

In 2016 Trump spent more of his own money than he took in in campaign donations. Candidates are allowed to reimburse themselves from donations. In that situation it is not possible to misuse campaign funds.

How do you get taxed for giving something away? You could say that would be on the other individual to take care of but doubt it happens.
