Biden was not President. He had no rights to keep classified documents period.

Hillary Clinton got away with having a classified set up and email in her own house outside of the govt wicket which was completely immune to FOIA and the president of the united states knew about it as well as the rest of the white house staff which emailed her on that classified email.
Guess how much trouble she got into for this
