There are probably a million Google hits for it but in very general terms it is developing a strategy they ends up asking the jurors to protect themselves and their community as opposed to focusing on the plaintiff's injuries.

Up until ~16 years ago you could use the Golden Rule argument where the plaintiff's attorney ask the jurors to put themselves in the plaintiff's shoes and ask them for an award they would want in the situation. US v Palma said this asks the jurors to forgo neutrality and give a verdict based on personal interest and bias.

Lizard Theory (from the lizard brain) just uses a different approach, which is actually far more calculated and requires more effort throughout the case, to focus the jury on something besides the plaintiff's damages and to think bigger picture. It is just another form of slight of hand.

Chiropractors and the Morris Barts of the world work in conjunction.

There are chiro clinics that only take “PI work” and they craft their medical reports like artwork to paint the worst picture for the lawyers case. And they suck each other off.

And it’s guys like that who make it hard to be a small business owner and getting to the point of effecting all of society.

Leeches to the system!!!

This. SBTX got rear-ended and then both cars got hit five minutes later. Should be clear cut fault. Including ours three insurance companies involved, none are cooperating, and over a month later repairs on the vehicle haven't even started. If our insurance would have stepped up and made us whole we probably would have ignored the back pain she is in, but because they didn't we had more time to figure out how badly she was injured and ultimately lawyered up.

Two months ago I don't think I would have ever thought we would lawyer up for a car accident. Reality is the lawyers and the insurance companies are both part of the problem. One necessitates the other.

Extremely.

Until judges start hammering lawyers and their clients for this shite, it will not stop.

And this won't happened because in many states, judges are elected snd the only people that donate to their campaigns are lawyers.

I watched part of a criminal trial. The defendant ran from the cops and crashed - hitting a car in the process. The prosecutor called the driver of the car that was hit by the defendant as a witness. He asked her "What was the first thing you said after your car was hit?" The witness said "We (talking about the guy in the car with her) gonna get paid!"

Among the lower class, car wrecks are viewed as a lottery of sorts.

Yup. There should be no payouts except for car repair/made whole and medical which is usually about $5k, which should cover “whiplash” they all seem to get. Nothing else unless it is bad injury with an ahole who caused it. Just this morning a PI lawyer commercial was on radio telling us to contact him to get what’s due from an auto accident. Scum.

And there are many idiots that will praise Gordon McKernon because of his NIL involvement in LSU sports but aren't smart enough to realize that he's a big reason why our insurance rates are high.

Litigation involved medical treatment and expert testimony are cottage industries now. Treatment plan, surgical recommendations, reporting, and on stand testimony (experts and physicians) are all valuable pieces to a suit and they pump plaintiffs through the process at a good clip.

That'd be true if the "Association for Justice" didn't heavily lobby the legislature and governor to keep the laws friendly to them. Hell, they elected Edwards with BP money. When the saw the writing on the wall with Landry the decided to donate to his campaign too and not to the democrat.
