The constitution. It gives the executive very broad and effectively supreme power over the borders, and the Court has consistently given the president vast power in that regard.

We've never quite gotten to a point where the executive is just refusing to exercise his powers to the detriment of the State to this degree.

So its gonna be interesting.

We've never quite gotten to a point where the executive is just refusing to exercise his powers to the detriment of the State to this degree.

So its gonna be interesting.


The same Constitution provides for a state to protect it's borders, would seem even more so in this case.

"Shall protect each [State] from invasion"

FedGov broke its Constitutional guarantee.

You kind of skipped over point A, if they are not abiding by the constitution, and their sworn oath in the first place....they cant be granted any executive powers.

If the executive can simply ignore wide swaths of law, why couldn't an executive simply say "F*ck it, I'm not enforcing the tax law. No one has to pay taxes anymore!".

It violates the basic idea of balance of power. At that point the executive has the power over the legislative branch. That's what made the most recent decision so rotten. It pretty much means the president can Veto congress in an unoverridable manner. He can just ignore the laws they pass.
