You ask neither permission from Congress nor forgiveness from the courts - when national defense or state border integrity is at risk, you take action. It's an invasion, not a dispute over immigration law or foreign policy discussions.
Texas should defy this order and invite people like ACB to come live at the border for a while, then take another look at the Constitution.

Take out the wire and deputize every citizen and instruct them that they are covering 30 feet in from the border. If anyone comes onto the land shoot them and give full immunity

If it was Pelosi, Biden, Obama, Bush's ranch/mansions being overrun you can bet this wouldn't continue.
