Not to high jack this thread, but the judges McD's hot coffee ruling was based on the exact $ amount referenced in a corporate email that calculated savings by keeping elevated coffee temperatures, thus eliminating coffee being thrown out.
Emails matter.

This lawsuit won’t go anywhere. Energy drinks with nearly that much caffeine simply have to put an age recommendation on the can. If 390mg of caffeine will kill you, well life wasn’t gonna last very long for ya. It’s like letting a peanut allergy kid run loose in a stranger’s kitchen pantry

Maybe but unlikely. I feel like Panera’s defense is the same as a peanut butter company that sells in stores and cafes. It is not their responsibility to ensure you don’t come into contact with it. That’s on you.

I've never been to a Panera. Are the dispensers behind the counter or self-serve? If behind counter, they should display where it can be easily read.

When you actually read the facts, it’s not too crazy. She required fricking skin grafts.
As to the energy drink girl, I think one of the articles mentioned she had a known heart condition and medical sensitivity to caffeine, knew the drink was caffeinated, and rolled the dice.
Same article pointed out that it was basically comparable to coffee.
