I realize this is the wrong place to say this but: at first I thought they had no real case against the passenger. I realize he's a sociopath, but he wasn't the driver.

However it appears that he was egging the driver on:

I'm not going to watch the video again. But if that's what happened, that would seem to be a deadbang case that makes the passenger just as guilty.
