the charge isn't "Possessing" the firearms, it's lying on a federal application.

Those are 2 different things. If the law is unconstitutional, take that up with the Supreme Court....that's not this case. This case is "did he lie" on a federal affidavit?

that's the thing. how can you prosecute lying on a federal form when the question that was intentionally answered incorrectly is deemed unconstitutional?

maybe lying on a federal form, regardless of what the question is, is what's being charged?
