Are these days all rolled into one (ie vacation and sick days treated the same)? If the answer is yes, then you are completely justified taking them if they aren't going to pay out for those days.

I know you hate to leave them in the lurch, but I don't think you are doing anything wrong or ethically fuzzy by taking some or all of those days if vacation and sick leave are considered under the same umbrella.

I mean, if you got sick, had surgery, had an accident requiring rehab and had to take all the days, then when you recovered you wouldn't have any left for vacation, correct? And they wouldn't give you extra, or if you went over you wouldn't get paid, so if I were the administrator in charge of you, I would realize its a headache for me to deal with, but that's the ground rules that that particular system is operating under.

Yes, all days roll into the same pot.

All true. I unsure exactly how FMLA works, but I would not have the days to get paid if I had a major surgery...especially early on in my career where the days were not accumulated.
