From these a loose timeline can be constructed. She left Reggie's sometime before 2 AM. The affidavit states the location of the rapes on Jennifer Jean drive. And then she was struck around 2:50 AM on Burbank.

Judge, how about under “felony murder doctrine”..?
2nd degree murder can be charged, and legitimately, if someone dies, and commission of certain felony is in progress, or intended. AND, this doctrine negates specific intent. I can speak from experience that kidnapping is in fact one of the underlying crimes which triggers FMD. It would be interesting to see if this arises down the road.
And on another note, judge, you recall a case involving former LSU player, drugs, drug dogs, ups, cell phones before you? Assuming you are who I believe you to be, you made the right call on this one! Prosecutor then now a judge… and now a friend. That case…..not so much.

Good thought. I can see issues with it, though.
There is no evidence as of now she was detained against her will. Please not I am NOT addressing consent to rape or maligning the victim. But the evidence so far is that she went with them voluntarily and that they let her out when she asked. Kidnapping may be tough.
There’s also an issue of a causal link between the crime and the death. If there is no kidnapping, there’s almost know causal relationship between the rape and the death (in terms of the statute, the “killing.”) At least that’s what I argued on Cheney Joseph’s final exam on a similar question involving arson! So felony manslaughter may be tough too.
I also think the prosecutors want to be careful about overcharging until they get this lined out.
Remember, these comments are me verbalizing straight out of the hind end. I do law, but not in this field.

Good list. I think you should add the podcast that was noted somewhere back in this thread where a rape victim (or two?) of the Washington guy reached out to them. I will try to find that link, but I thought it was a good listen.

Absolutely. If you kept everything the same in this situation, kept all of the known evidence the same but it were 2 white guys doing this to an attractive black 19 year old sorority girl and then they leave her on the side of the road and she gets hit and killed by a car, those black posters would want the white guys to get 50 years in prison. They would view her as a 100 percent victim and use this case as evidence of racism in America. They would talk about how white men are ALWAYS raping defenseless black women.
But since it's an attractive white girl and two black perps, they side with the black perps no matter what.

If I were on the jury, I would question why they released that video and not other videos showing her intoxicated. I would say that's being deceitful and either they should have released all the videos or none at all.

If an 18 year old can know, so can a 17 year old. If 18 year old Kaivon could tell she was wasted, then so could the 17 year old. In real life, there's no difference between a 17 and 18 year old. He's old enough to go to a bar and stay out drinking and having sex into the wee hours of the morning, then He's old enough to know when someone is or should be intoxicated. Don't make him out to be some innocent baby.

The question isn't about who she showed interest in, it's about her ability to consent. They can't let the 17 year old off the hook and pin it all on Washington. After all, the defense will say if she was lucid enough to give meaningful consent to the 17 year old, then she was lucid enough to give consent to Washington, since they had sex with her one after the other. They have to take both down.
