I haven't followed the case in the last few weeks nor read the award but did they lose their UTP Act claim? If not then they are not limited to the costs of bringing the action. Costs of bringing the action is wider than attorneys fees but that is relatively pedantic unless you are actually doing the accounting.

We said they were all liars, it was a scam, no one was injured, and some really heinous shite. Plus put his army of Morons on the parents who threaten them etc.

We crossed the line here. Free speech has some limitations. You can say whatever you want but if you slander someone they can sue your arse

Sure. You can set parameters that cap punitives.

But capping them at fees and costs is stupid and does not serve justice in certain situations.



If it can be shown by a preponderance of the evidence that a tortious act was committed for monetary gain, why can’t the cap be whatever amount of money is shown to be connected to the tortious act?

If my tortious act against a person brings me 100m in revenue, why should my liability be capped at a fraction of that?

Seems like a billion isn't enough to call the murder of 26 kids a hoax. Weird that some of you are okay with this. Actually it is fricking disgusting and nothing weird about it.

what if it were your kids that were murdered and you were doxxed and people showed up at your door and people called in threats for almost 10 years. Seems like some of you would be okay with that. all the while some fat frick is making millions off of it.

Because what you profit isn't relevant at all. What's relevant is the damage to the aggrieved party. And as multiple posters have said, wrongful death settlements and verdicts don't even approach the award here. The 30 Columbine families split under $3 million from multiple defendants, including the people who actually procured the killers weapons and committed crimes.

Justify to me why Alex should pay 30 times the amount of cash for shite talking grieving parents than OJ who murdered his ex-wife and her lover in front of the house where his kids were sleeping. How are you going to quantify how much AJ made DIRECTLY from talking about SH? Did his revenue go up or stay the same before he talked about it? Did it drop after he stopped?

You keep posting the same argument and it's a stupid one in this case because there is no way to calculate how much, if any, of his profits were solely based on talking about SH.

His profits are from years of building his brand from talking about a variety of topics.

Our system should seek to disincentivize tortious acts.

If a tortious act is generates revenue for the liable party, the court system should take that revenue away from the liable party.
