It's not quite that simple. Granted, I've only done one civil forfeiture case related to drugs, but I'm fairly certain that the state has to offer more than just "she has money".
Wrong. This is literally ALL they have to do. All they need do is assert that it looks fishy. That's about it.

Looking at it from the government's perspective, which I don't always agree with, I can't think of a scenario where someone would have $100K in cash on them that wasn't either ill gotten gains or lawful gains that were untaxed where there wasn't a paper trail for it.

Cool story. The burden of proof is ON THE STATE. Not the burden of likely or the burden of, gee, seems odd or the burden of, come on, who would do that.

PROOF or GTFO

This is the part that she did not have.

The linked article is very weak on details so who knows.

Yeah, do you know how many people have had their casino winnings just point blank stolen from the cops thinks to civil forfeiture? Thousands of people, and they haven’t even had the opportunity to go put it in the bank. “99.99% of the time they’re drug dealers.”

And don't get me wrong.

I suspect that well over 90% of all forfeiture cases are of people who legit have the money for non legit reasons.

But, that ain't how shite is supposed to work in our country. In our country, the government is supposed to have to PROVE that shite. Not just say, "seems likely bad.........no YOU prove it ain't".

That ANYONE thinks this is OK is mind boggling

So if the owner never challenges it, the state has to provide what?

You can't leave the casino without paying taxes on your winnings. The IRS knows where you got it before you even take possession of it. Paper trail.

Yes, I’m thinking it’s like 9% that aren’t criminals rather than 99.99% that are criminals as that idiotic poster said. That 9% is worth defending even if the other 91% get away with it.

One study found that 80% of people subjected to civil asset forfeiture are never charged with a crime connected to the asset.

In 2008, the DOJ’s forfeiture fund topped $1,000,000,000. There’s no profit incentive though.

Well, nothing. Just like any civil case, if one party doesn't show up, it's a default verdict.

Well I never told those pieces of shite on my casino winnings nor will I ever save for winning a major jackpot. The IRS isn’t going to find out dick on my winnings the last time I was in Vegas, and they can frick off, as can every single person who works for them. People in the IRS and the funeral industry are universally horrible people.

It was probably meant to be a down payment on a painting by Hunter Biden. I feel bad that "the big guy" will be missing his cut.

That's outrageous. This is the sort of practice that people need to demand be ended.

Sounds great. When does she get to have the state prove their case against her beyond a reasonable doubt?

When she shows up and fights for it.

What are the chances?

Police are no longer prosecuting theft, so why not partake in it?
