Was it a pinky swear? If not, your only recourse is to sully his good name. I doubt you’ll have trouble finding someone else who wants to sell you their camper.

To me the bigger question is why are you buying a camper? How often will you use it? Unless you are a retiree who will be out seeing the country for at least 3 or 4 months of the year it seems like to me buying a camper is a huge waste of money.

More cost effective to rent one every now and then when you want to take a trip (which for most working people is once or twice a year).

It is needed for specific purposes and the fact that we have dogs. Combination of essential/recreational.

I have looked for a very long time and finally found the one we needed. Also the fact that it was local. Buying out of the area creates too many problems

How much are you willing to pay a lawyer to pursue the case for you?

I start law school in August. I am willing to take this as my first case, but you will have to wait four years.

First rule of selling shite on Craigslist or FB marketplace: Until there’s money in hand, its still for sale. Buyers on there flake out all the time and don’t show up.

You should have had funds at the ready when you went to look at it. At minimum, enough for a deposit.

I’m gonna try to be nice but you’re being ridiculous if you want to pursue this. First of all the juice won’t be worth the squeeze if you pay legal fees. A lawyer in small claims would cost what, $2500? I guess you could represent yourself, but seeing as it was a verbal contract I don’t like your odds on that.

People flake out all the time especially on large purchases. Or they show up late. Or they try to haggle last minute when they get there. I don’t blame the guy for taking the money upfront.

In my experience, with buying boats and four wheelers, and such, if the transaction doesn’t happen, smoothly to where I feel great about it. Usually it’s a sign I shouldn’t of done it.

We are very unhappy about this outcome. Is it enforceable?

No, just grow up and move on. Think of it as maybe you will find something better.

Contracts over $500 have to be in writing unless any money changed hands.

Same thing happened to me with a pistol I was wanting to buy. I called the guy and was planning on meeting him that day with the money. When I called to tell him I was on the way he said he decided to give it to his cousin or some crap like that.

The thought of legal action never crossed my mind.

A judge can’t force them to sell to you. You can only hope to be recouped for damages, which you have none other than maybe the gas it took to go get the money.

Not true. You can enforce an oral contract in Louisiana. Harder to prove though. You need at least one witness and other corroborating circumstances.

Until you exchange consideration (some sort of payment or physical good), a handshake deal is really just a handshake. Until the parties actually exchange something of value or sign something, they’re still basically haggling.

That’s why so many places ask for a deposit upfront. The deposit serves as consideration, meaning the contract is now in effect.
