That and then the burden of proof suddenly falls on him for somehow proving he didn't do something that never happened. This is why smear is so common in politics.
Only people with frick loads of money like Trump sue.

The fact that the accusations are falling apart very publicly likely has some impact as well.

Because Moore is considered a "public figure" and his lawyers know the burden of proof is so high it would be a waste of time.
