What happens if RBG or another Justice passes away/retires in 2020?

The Republicans control the Senate, but it will be a Presidential election year. Will Mitch table the search for the next justice until after the election like he did for Merrick Garland?

Why worry about seating a replacement?

The court would be 5-3 conservative.

Think about it. Biden was the majority leader, HW bush the president. They could not “agree” on a candidate. Same with Mitch and obama.


This situation is not applicable bc Mitch and trump are on the same page and since Harry Reid changed the rules, repubs only need a simple majority and do not require democrat consent


Dems made rules, repubs are just playing by them
