I keep seeing he paid "hush money" to a porn star prior to the 2016 POTUS Election, but what is the actual crime?

I posted this earlier:

It's how the money was moved/accounted for.

If Trump had just written a personal check, it wouldn't be a crime. The problem is this would be able to be tracked back to him, so he used intermediaries like Cohen and a complicated money moving routine so Cohen would avoid being taxed on the money. They also did it in multiple transactions so that the exact amount paid to SD wasn't accounted in a single transaction (again, to hide Trump's association).

The big issue is if they used campaign funds as part of the money given to Cohen (and unwinding that).

It's a major reach, though.

It would be a misuse of campaign funds, which is a misdemeanor that no one is ever charged with. This is why politicians will leave money in their campaign fund after the election for a year or more. In case something like this comes up. It basically amounts to a NCAA grade 2 violation. The Federal Election Commission and DOJ already looked at this payment and declined to prosecute. Meanwhile Hillary had to reconcile paying for the Steele Pee Pee Report with campaign funds and got a slap on the wrist. This DA is somehow gonna morph th misdemeanor into a felony for shits and giggles.

So, in other words the same way all 535 members of Congress do their insider trading.

Got it

No you're wrong. They don't hide it because it's not illegal (for them).

Apparently it is illegal (federal offense, may or may not be a state offense depending on state) for candidates to spend hush money from campaign funds.

Michael Cohen paid the money and it is not illegal to pay people hush money from personal funds.

The issue as been looked into by the DOJ via the SDNY and the case was never pursued due to the lack of evidence showing the hush money was paid via campaign funds.

Trump paid Michael Cohen legal fees and Michael Cohen paid $130K in hush money.

The Manhattan DA is pursuing a case against Trump because he thinks Trump paid Michael Cohen with campaign funds. Alvin Bragg can read minds.

The big issue, as I read it, is that they had to manipulate it in a way so that Cohen wasn't taxed on these "legal fees", which is where the potential issues arises. If Trump pays Cohen, Cohen pays her and the taxes, there is no issue. Cohen probably could have expensed this as a client expense, too, but they had to bundle multiple payments to make sure that the exact amount couldn't be associated to Trump. That made things difficult.

Cohen is such a dumb shite. He should have billed Trump with the $130K grossed up and paid the damn taxes.

Has there ever been a single presidential campaign that hasn’t misused funds? Weren’t Obama and Hillary both fined for misusing funds at one time? It’s so laughable that this is what they are going with

How does hush money work when the recipient doesn't STFU? Does she now owe Trump the money back and penalty?

He could try to sue her, but then he'd be opening himself up to discovery so it's probably not worth it.

She already owes him $300K so that would be trying to extract blood from a turnip and she already denied having an affair in 2018.

This is why people hate lawyers.

Trump’s BUSINESS wrote a check to Cohen. Not Trump’s campaign.

Cohen deducted his fee then disbursed to Stormy.

If every time I deducted my fee before disbursing settlement funds, i was helping my client commit an unspecified crime , I’d be in deep shite
