Kagan pretending that people aren't going to the hospital because they are scared of getting Covid from staff.
Right, it's not because hospitals canceled all elective procedures.
Also... I thought the hospitals were full, overflowing even? Are they full of patients or are people staying home in fear?
And now she's effectively making Gorsuch's point that CMS IS using the spending clause to COMMANDEER staffing & tenure.

He finally brought up the point of not being able to remove a vaccine as if it is PPE.

Kavanaugh needs an explanation of how wearing a mask and washing your hands at the hospital is different than requiring people to undergo a NON-REVERSIBLE MEDICAL PROCEDURE.

Finally! Gen. Murrill getting to the meat of the argument.

Louisiana Solicitor General doing MUCH better than Missouri's.
She came prepared, he was stumbling even before Kagan and Breyer started attacking him.

sometimes these types of questions are put there for the arguing side to make their case and slam dunk the basketball -- but it can also hurt them if they do not have a good response
in other words, I've seen judges who do this who may be leaning one way and want you to help convince them by trying to give you something to nail down -- but in that case I did NOT think the attorney did a good job there other than going back to the small towns/states rights thing

I’ve lived in corporate America my entire damn working career. People report so much shite to get away with things itsamazing. All of those things will happen and more. -the test causes eyes to water, cznt see or work properly, lawsuit. -vaccinated co-worker promoted, HR complaint -driving to clinic to get tested causes car accident, sue for damages It’s opening the floodgates for people to overwhelm the legal and HR departments.
God this is so true.
The excuses people will come up with. And HR depts cater to these people which makes it even worse on managers.

Agreed, I'm not sure which way Kavanaugh intended the question but MO attorney fumbled his answer

They seem confused with Gen. Murrill's argument.

So on the private employer mandate, what is the court going to do? How does it seem they are leaning?
