Kagan pretending that people aren't going to the hospital because they are scared of getting Covid from staff.

Right, it's not because hospitals canceled all elective procedures.

Also... I thought the hospitals were full, overflowing even? Are they full of patients or are people staying home in fear?

And now she's effectively making Gorsuch's point that CMS IS using the spending clause to COMMANDEER staffing & tenure.

Kavanaugh needs an explanation of how wearing a mask and washing your hands at the hospital is different than requiring people to undergo a NON-REVERSIBLE MEDICAL PROCEDURE.

sometimes these types of questions are put there for the arguing side to make their case and slam dunk the basketball -- but it can also hurt them if they do not have a good response

in other words, I've seen judges who do this who may be leaning one way and want you to help convince them by trying to give you something to nail down -- but in that case I did NOT think the attorney did a good job there other than going back to the small towns/states rights thing
