The judge dismissed the least serious charge and refused to dismiss the more serious charges, the ones that could lead to life in prison if found guilty. And he refused to dismiss any of the charges against the other cops who were there.

It was bad news, not good news.

Actually, perhaps not. Having "lesser included offenses" give jurors 'wiggle room'

"The DA did not prove Murder 1 beyond a reasonable doubt...so, I will compromise to 3rd degree"


General, defense attorney wants to have those lesser ones removed to guard against "he must have done something..but, not that REALLY bad one"

Considering in this case it was a defense motion requesting all charges be dismissed and the judge refused the defense's motion on most of the charges, I'm pretty sure it was an "L" for the defense.

Exactly. The State uses those as fall back when they can't meet the burden of proof.

The whole rationale is they hope the jurors think (after not being able to agree) well, hell the State hasn't met their burden of proof but we know he's guilty probably or maybe...I don't know...lets just convict him of this lesser crime as a compromise.

That is every case ever, right? Defense asks for dismissal

ETA: BTW, frick Chauvin and his bullshite. So, I am just discussing the court action. Not my characterization of the "great day" OP
