Today Gov Kemp Signed Into Law House Bill 838 Giving Police More Rights

The bill allows:

- Police Officers to file civil actions against any individual, group, or organization that abridges a police officer’s rights

- Mandatory 1-5 years in prison for any person guilty of maliciously harassing a first responder or causing bodily harm or damage to police or first responder property

Gov Kemp:

“While some vilify, target, and attack our men and women in uniform for personal or political gain, this legislation is a clear reminder that Georgia is a state that unapologetically backs the blue.”

Governor Kemp lookin' good for '24 to be sure. When I compare the governors of the sate of my birth (Georgia) and the state of my present residence (Virginia) I feel like I've been caught with my pants down around my ankles.

Did he define these "rights"?


Are they any different than a citizens?


It's just that the terminology used is suspicious.

ETA:


And...





Do they still have qualified immunity?


Are they still allowed to practice civil forfeiture?


If the answer to the two above is yes, then it sounds like he's strengthening a police state.

I don't get this love affair with Kemp.

He kept quiet while the rioting raged in Atlanta. He joined in the judgement before trial of the McMichaels in Brunswick. He has been all over the place with COVID saying the masks can not be required, but telling people it is important to wear a mask, etc. He was pretty silent as well on the railroading of the Atlanta cop who had to kill that violent drunk in the Wendy's lot.

When he has balls and stands up to demands to sandblast Stone Mountain, I will be impressed. I am not expecting courage on that front.

To me, he is the typical upper class, faux good ole boy politician who is mostly talk.

Was it illegal for police officers to sue people abridging their rights before?

Was it legal to attack police or first responders before?

What does "maliciously harassing" entail? Are people going to be arrested for yelling at police? Is the media or politicians going to be arrested for speaking unflatteringly about officers?

I don't support mandatory sentences. Not every situation is black and white.

It sounds like this just gives police more freedom to abridge other people's rights with little accountability. Why not just enforce the laws already on the books?

Not true. He has condemned it forcefully and consistently, pressured Mayor Bottoms, and called in the National Guard twice, the second time in open and declared defiance of Bottoms’ opposition to doing so. The first round of rioting was stopped directly as a result of Kemp calling in the Guard and the second round of rioting was stopped partly due to his calling in the Guard a second time.

I don’t see this as a negative and personally appreciate and understand his policy: that he recommends people wear masks but will not mandate that people wear them. Seems reasonable to me, offers guidance, and ultimately respects peoples’ individual freedoms and decisions.

I would like him to say more about the situation but I understand his strategy of not wanting to throw gas on a fire at this particular point in time. He did do the following:

I am. Regardless, no one is taking calls to blow up or sandblast Stone Mountain seriously at this point so there really isn’t a need to say anything about it. Right now, he has received many calls from national media to comment on Stone Mountain and he has declined all of them. I honestly think that’s the best thing to do right now.
