Have the DOJ Challenge the 14th Amendment’s bastardized birthright citizenship provision.

The amendment has the clause "subject to the jurisdiction therein"

That has been interpreted through congressional statute and not by the Supreme Court.

For example Children born to diplomats are not given American Citizenship

Because law says that. Law could stop the children of non citizens from being granted citizenship here the same way.

There is an argument that a statute would suffice. Not sure what the DOJ could do, though.
