The abuse of the 14th amendment

Tucker last night inspired this thread.

We all know, or should know, that the 14th amendment was written SOLELY to deal with slaves and their children so IRL it's a dead amendment meaning it shouldn't be applied to anything today.

Should Trump write an EO "stripping" anchor babies, regardless of where they're from, from their automatic faux "citizenship'?

No, but I like bringing up the slave issue about the 14th when leftwits bring up muskets when they talk about the 2nd. They generally shut up after that.

The second amendment was only written to protect us against the government. Since that hasn’t happened, let’s kill it too.

There was a segment on NPR when the immigration ban was in limbo in the courts, and the people "stranded" in route to the US.

One was some woman, bless her heart, from one of the banned countries, who wanted to be with her family....when birthing her child. Convenient eh. She was bitching up a storm about how her child would be born in some shithole instead of the US. I puked.

Better is bringing up that the founders didn't know we would have telephones, the internet, and television. . .therefore Free Speech and Press should not apply.

It would undoubtedly go to the SCOTUS. Perhaps he should preface his EO with his interpretation of the 14th saying it only applied to the recently freed slaves and their progeny.

Make the SCOTUS deal with that argument directly = screw 'stare decisis' = rule by constitution not flawed prior mistakes.

The exclusive arbiter of that decision (SCOTUS) has already decided that it is.

Congress may change the amendment if they so choose and it’s agreed upon by the states.

Either way, there is absolutely nothing that the executive can do about it other than challenging the law in court. And the odds SCOTUS, or any of the Circuits, takes that case after a district judge slaps it out of his courtroom are slim to zero.

Any EO doing what OP describes would be injoined before POTUS’s ink dried.
