First, thank God he didn't kill anyone in the wreck, as he was WAAAY too drunk to be driving.
But this wasn't completely crazy or anything. I think his BAC was just over the legal limit too when they took blood at the jail

Certainly shouldn't have been driving, but I echo what others have said - this is probably mild-to-mean as far as DUI videos go.
Other observations - dude is in good shape for 82. Also, unless the cop is tiny, he's big AF.

He isnt that big...maybe 6 feet. He is standing a lot closer to the camera than the officer, who might be slightly shorter than him

I don’t know how the Napa DA would normally handle this but most rural areas would be similar for a local. The biggest advantage was waiting two hours to take the test. His body would have processed 1.5/2 oz of alcohol in that time period. At least according to the DWI class I attended nearby 40 years ago.

They waited over 2 hours to administer blood test for BAC. They did all they could to let them go away. He was still drunk after all that time.
