RNC having to file yet another election lawsuit, this time in Wisconsin
Posted by Bamatab

quote:
The Republican National Committee filed an election lawsuit Wednesday in the battleground state of Wisconsin against Green Bay’s county clerk, who has allegedly been prohibiting members of the public "from observing all aspects of the in-person absentee voting process that has been underway since October 25 at the City Clerk’s office," according to the legal filing.
"The RNC is suing Green Bay alongside concerned Wisconsin voters because the city's Democrat election officials are refusing to follow Wisconsin’s election law," RNC chairwoman Ronna McDaniel said in a statement. "Poll watchers have a right to poll watch, but Green Bay's clerk is refusing to let them in the room."
quote:
The RNC is seeking a temporary restraining order and injunction against Green Bay's city clerk, Celestine Jeffreys, to prohibit her from violating a state statute that requires municipal clerks to "allow the public to observe all public aspects of the in-person absentee ballot voting process," according to the lawsuit.
GOP lawyers are also requesting "an order and a declaratory judgment regarding the proper construction of the Wisconsin Statutes requiring that the public be afforded the ability to observe all public aspects of the in-person absentee ballot voting process."
quote:
Wednesday’s lawsuit is the 75th legal action filed this election cycle by the RNC, many of which have been successful, including most recently on Tuesday in Pennsylvania where the state’s Supreme Court sided with the RNC’s arguments to not allow misdated or undated absentee ballots to be counted.

So why does the RNC have to sue Green Bay? If the law says poll watchers have a right to poll watch, who cares what the clerk says. Just refuse to leave when the clerk tells you to leave. Are the actual police going to forcibly remove the poll watchers when the law says they can be there? At some point the republicans are going to have to physically stand their ground, and tell these people to pound sand.

This X 1,000. If the law is not being followed, then the cops should be called on them. Not the other way around. Refuse to leave. Call the local news station. The court is not the place for this so close to the election.

THIS is actually the problem and until conservatives finally abandon our moronic "blue line" knee jerk support, it'll continue to bite us.
The police aren't remotely your friends.

No doubt the cops will remove and arrest those viewing. Look at the 2020 election as example #1

Exactly, but sure as hell don't let them continue to count votes when the poll watchers aren't being allowed to watch them. Every available RNC person and lawyer (especially the lawyers) need to take their asses right into that county clerks office, with a copy of the law, and tell the police if they don't force the clerk to let them stay there per the law, they will sue the hell out of the police department, not the city of GB. And force the police to either comply with the law or arrest the RNC reps knowing they'll get the hell sued out of them.
But at some point the RNC itself is going to have to take more drastic steps to force the city officials hands. This is the 75th lawsuits already in this election cycle. Taking these city officials to court doesn't seem to be working.

Yes, absolutely. Cops arrest people all of the time because they think something is against the law when it isn't. The general cop really doesn't know the law and just does what they are told.

Then have your lawyers there with you with a copy of the law in writing, hand it to the commanding officer, and say that if you physically remove us from doing our job per the laws of the state of Wisconsin, The RNC will sue every police officer that is complicit with violating that law by removing the poll watchers.
ETA: I have a hard time believing that the police officers would really be willing to be sued if they are handed hard copies of the law by actual RNC lawyers.

When a Dem minded clerk prohibits a person from the other side of the aisle to observe the vote counting, it’s called saving the Democracy.
When a Republican seeks to oversee the counting process to make sure it’s transparent and fair, that’s called voter intimidation.

Police officers enjoy qualified immunity that is nearly universal and they really kinda get off on fricking with people. So, yeah. They'll do it.

You'd be amazed at just how few police officers even know the difference between private property and public. I would say MOST of them think "state" property is "private". They're idiots.

That's why I said have the RNC lawyers there to hand them copies of the actual law, and if the lawyers also need to prove to them that the court house/clerks office is state property, then they can do that as well.
Cops may get away with fricking with regular people, but lawyers representing one of the two major political parties in this country would be a different story if the RNC actually tried to push back against them.

I wish I had your confidence but alas, from what I can tell about the police, not a chance. First off, after your lawyers show up, the police are gonna call the mayor who is going to order them to obey the clerk or get fired.
And, then, the officers are going to arrest people all while knowing that worst case scenario, the lawsuits will result in the CITY paying money while the officers don't get touched.
Stop trusting the police. One of the very few things the left has right is their view of the police. Conservatives are, quite simply, wrong on this subject.
