Judge Marabella will not be missed.

So you're related to a public defender in what is now the Honorable Fred Crifasi's courtroom? Which one? I know them all quite well.

If 1st offenders for simple weed possession can get 60 days to 6 months is absurdly random, what heroin possessors get for sentences is just as absurd.
Still wrong, but not quite as wrong as before. Old law was 4-10. Now it's a rather hard to memorize weighted schedule:
quote:
(4) A substance classified in Schedule I that is the narcotic drug heroin or a mixture or substance containing a detectable amount of heroin or of its analogues, or fentanyl or a mixture or substance containing a detectable amount of fentanyl or its analogues, upon conviction for an amount:
(a) An aggregate weight of less than two grams, shall be sentenced to a term of imprisonment, with or without hard labor, for not less than two years nor more than four years.
(b) An aggregate weight of two grams or more but less than twenty-eight grams, shall be sentenced to a term of imprisonment, with or without hard labor, for not less than two years nor more than ten years and may, in addition be required to pay a fine of not more than five thousand dollars.
***
(a) Any person who knowingly or intentionally possesses twenty-eight grams or more, but less than two hundred grams, of a narcotic drug (all substances in Schedule I preceded by an asterisk "*"), shall be sentenced to serve a term of imprisonment at hard labor of not less than five years, nor more than thirty years, and to pay a fine of not less than fifty thousand dollars, nor more than one hundred fifty thousand dollars.
And if they get convicted a second time, they are exposed to habitual offender prosecution. That means you take the numbers you see, ignore the minimum, and do the following with the maximum: the new minimum is 33% of the standard maximum and the new maximum is double the standard maximum. And this time is served flat.
We're talking the potential for massive jail sentences for simple possession of narcotics.

Not related to a defender. Nor related to someone solely related to Marabella's old courtroom.
Many judges, many employees, many friends, and who I know is none of your business.
You a PD, prosecutor, or ambulance chaser. If a defender there I'll communicate off the record i.e. not here.

I'm a criminal defense attorney. I'm disinclined to give more detail than that on here, in spite of my now oft repeated line that the only reason I've yet to be doxed is that no one gives a shite
If you'd like to communicate elsewhere, let me know.

Cool. I'm good with protecting identity. Can I ask what section of the PD's office you are most familiar? Just the section #. No biggie if you don't want to answer.

It's just really hard for biased people to accept that the status quo is causing major problems for society, and that decriminalizing (or legalizing) will not drastically increase addiction

Based on the response, I presume that rung a bell
No need for Sonic. I was in an aggressive mood earlier. It happens

I agree on marijuana but "harder" drugs is more complicated.
Hell, even testing on the spot for weed is complicated. Regs are needed before legalizing imo.
I'll see y'all tomorrow. I'm way past bedtime.

Although it's not perfect, Portugal's model of decriminalization is promising. Criminalizing drug/use possession has a minimal effect on drug abusers. Get them help and it will be much cheaper in the long run.
