PT Lawyers Need Advice EDIT page 6

This past week my youngest son (13) came home and told his Mother and I that Friday he and several other boys were going to a friends house for the Mother of all Air Soft wars. Of course I didn't think much about it. The boys have played these games at the house before and we've never had any problems. They all wear eye protection and shoot the piss out of each of other.

Tuesday morning my son Snap Chatted a picture of his air soft rifle that read....We are gonna light it up Friday!

Yesterday morning the school police officer shows up in his home room class, asks him to stand, places handcuffs on him and leads him to the office where the Principal and several teachers begin to interrogate him about having a firearm on campus. By the time they allowed him to call me he was in tears and I was asked to come pick him up. Meanwhile they had put the school on a full lockdown and in our tiny town folks were freaking out.

It took every bit of restraint I had to listen to the Principle relay the following story to me. At 7:15 that morning, a young girl showed up in his office and showed him the picture my son had put on SC. He said that the girl went on to tell him that she felt like my son and several of his friends were going to shoot the school up and even told the Principal that they had brought guns to school.

Of course while my son was being perp walked to the office, they were going through his locker looking for a non existent gun. I was told not to bring my son back to school until we had met with the school board next week.

Do I have any recourse against the school in this situation? Can my son be charged with any wrongdoing?

I’m sorry, that’s a terrible story. I hate what our country has become sometimes.

Talk to a real lawyer. You have some things to talk about. Don't listen to one word any "lawyer" on here posts.

I'm sorry! And yes, definitely get a real lawyer, preferably one versed in dealing with the school system. Do understand that you're dealing with flaming liberals and you'll need a strong advocate. And, at some point, do have a good talk with your son about posting on any social media. Nothing good comes of it!

Welcome to the depths of school zero-tolerance policies and an absence of common sense.

What “recourse” do you think should exist? Our wise legislatures have determined to frick individual rights.

Honestly, clock boy had little rights (made up or not) for the same reasons yours won’t. We are so petrified we put our schools into this overreaction situation.

One thing that really surprised and disturbed me is the fact that our Principal isn't a liberal or even liberal leaning. I feel like he simply over reacted without gathering all the facts.

We had the "talk" and amazingly the very next day several kids got into trouble for posting a picture, holding a large white sheet that read....the real nigg@$ house! White kids.........

Get ready. My parents had to lawyer up several times against the school board over my autistic brother.

They don't give a flying frick if they're right or wrong. They will fight you to the death.

Someone will have the picture. Picture will show it was an airsoft gun. Your son likely has texts with his buddies about airsoft.

Sorry to hear that happened to him but unless there was something obvious in the picture like an orange tipped barrel or a CO2 cartridge I don’t know what fault the school would be in. If the officer handled it wrong maybe the police department that assigned him could be at fault.

Oh come on? What “real lawyer” do you know that’s going to give this guy advice other than he has no recourse against the school.

His kid has the right to appeal and have a determination of the punishment, and it may be ameliorated based upon the facts. He also may get someone who is not an administrator who has his hands tied actually get the chance to be sympathetic about it.

But he asked about what recourse he has. That answer is little to none. And everyone knows it.

If the gun in the picture had an orange tip then it's clearly a toy and that can be part of your argument and misinterpretation. The problem is that, right now, this is a hot topic (blame whoever you want, that's not the point right now) and these public officials feel like they're in the spotlight. If you have any lawyers in the family, get them to help or recommend someone who can. You need some legal power in your corner.

All of that may be true, but he still doesn't need to listen to the Poli Board for anything related to his kid, school, and guns.

When I asked about "recourse" I should have specified that I was more concerned about the potential for expulsion. I have no intention of going to court over the mistake they made or the way he was perp walked to the office.

Life is too short. I just don't want him to miss any school.

Very true. I was just giving my gut shot thoughts. I’ve seen too many cases with this shite, and it pisses me off to no end.

Talk to a few attorneys before picking one FYI.

And while it’s absolutely understandable for the girl to report it and the school to investigate, it should not have escalated that far that fast.

Christ almighty someone ask the kid what that SC was.

If the SC said “we killing everyone at the school Friday” then the response would have been appropriate

It doesn’t matter if it’s a toy or not. Your kid could get expelled for making a finger gun or chewing his pop-tart into the shape of a gun.

Zero Tolerance policies were idiotic when I was in school, and they’re even dumber now.
