Potential Problems with the Vaccine & Testing Mandates

Mandating that employers with over 100 employees require vaccines or testing of its employees is a violation of 14th Amendment’s Equal Protection Clause because it doesn’t apply to employees working at companies with 100 or less employees. In addition, exempting USPS workers, members of congress and their staff is also a violation of the clause.

The creation of an OSHA standard to force companies with >100 employees to comply with mandates will define workplace exposure to COVID-19 resulting in illness as a work-related illness and will result in workman’s comp claims and lawsuits.

For a company like Walmart whose employees will be compelled to abide by the mandates, what about the millions of customers that enter Walmart stores each day? Shouldn’t the Walmart employees be afforded the same “protection” from unvaccinated customers entering its stores? By not requiring that customers be vaccinated or have a negative test result, would Walmart not be guilty of creating a “workplace hazard” for its employees?

Every employee in every targeted company should begin demanding a program establishing the right to know the status of all other employees health condition regarding all infectious or communicable diseases.

They should demand information on employee's with aids, hepatitis, flu, mumps, and so on.

Serve the employer on the first day they attempt to mandate your records so that they immediately segregate employees who have any illness that could spread, including the common cold.

If they are taking responsibility for stopping the spread of Covid-19 in their workplace, they would then be responsible for the spread of anything else.

Do it. Hire a lawyer to do it if you need to.

Will be very curious.

Our school system, Fulton County (GA), had a TON of teachers quit after the last school year. The school where my wife teaches had a few quit just days before the year began. Some have left the field, most have gone private, found a different system they prefer, or even decided that tutoring is preferred. They were so worried about people quitting that they threatened $1000 fines for breach of contract for anyone that had signed for the school year.

The superintendent sent a note this weekend that they aren't planning on mandating the vaccine, but they strongly encourage it. They are in a wait and see approach to see how the litigation pans out.

My wife's co-teacher is black (special ed), and neither she nor my wife are vaccinated. They keep saying the % vaccinated is high, but it's funny in the circle of friends she has from work, almost none are vaccinated.

I don't see how the system can absorb losing some 15-25% of the workforce if they were to be forced to "fire" teachers because they won't vaccinate. People would be outraged that their kids were now forced into remote learning or into classrooms with 40+ kids.

Kind of like the Safety Data Sheets that OSHA requires companies to provide to employees with information on the hazards of working with a chemical and procedures that should be used to ensure safety. SDSs are a primary source of information regarding chemical hazards and handling.
