Fox 8 New Orleans
I’m speechless at how absurd this is. Trying to put liability on a victim of a crime.

NEW ORLEANS (WVUE) - A bill proposed by a New Orleans state senator would hold gun owners liable for civil damages if their firearms are stolen from unlocked vehicles and used in subsequent felony crimes.

The perpetrators have no responsibility for their thefts of items used in additional crimes

It’s like suing the car company for someone driving drunk and crashing.

What in the..frick?
So a person 2 felonies removed from an injury to another now has a nexus for liability because of one of those crimes?

It’s actually worse than that. The car company at least made the car. And this scenario it’s just a crime victim, having his possession stolen, and then being liable for their subsequent use.

P.S.
I still do NOT support this proposal but admit a large part of stolen gun problem lies with the owners being too stupid and/or lazy to carry their weapons out of their known theft target. It's not like auto burglaries/thefts are a rare thing in NOLA metro area. It's even more frequent than daily really as it occurs possibly hundreds of times a day there.

La. senator gary carter (D) is the sponsor of this bill.
Hope the bill does not get out of committee.

Don't be. It is where we are now. They will throw your arse in jail for owning a gun, one way or the other.

All the ridiculous stuff aside, What is the mechanism/threshold for determining the vehicle was 'unlocked' and to who has the burden of proving/disproving this element?

well, if your gun was stolen from your unlocked truck last night, just lock it and bust the window.
also, i wonder if this applies to knives. i see a lot of irresponsible knife owners out there.

I had one stolen several years ago, but the truck was locked.

How, exactly, would they know this?!
Posted on 4/13/23 at 7:42 am to Junky
So who is going to determine if the car was unlocked or not?

If someone proposed a bill that anyone on food stamps who sold their Louisiana Purchase card to someone else was responsible for paying cash for all the fraudulent purchases, this same Senator likely loses their shite.

If they would quit creating gun free zones, maybe people would not leave their firearms in their vehicles in the first place?
Beyond stupid but Alabama is looking at something similar, unfortunately...
