AR-15 from Army vet charged with attempted murder

fox news

quote:

Florida deputies confiscated an AR-15 semiautomatic rifle from an Army veteran on Thursday, and the seizure was the first of its kind under the state’s new gun control law enacted following the Parkland school shooting.

quote:

Another provision allows law enforcement to apply for a "risk protection order" from a judge to seize the guns of the mentally ill and anyone deemed a danger to the community.

Broward deputies sought the order in Smith’s case after he was arrested March 29 on an attempted murder charge for allegedly firing six shots into the back of a car being driving by his best friend, Jackon Lavon, 34.

quote:

“They just raided his house, found all his weapons, or whatever, (and) they just took it,” Smith’s neighbor Lorenzo Brown told WPLG-TV.

wouldn't they have done this anyway without the law?

I believe so. Seems you can easily Baker Act someone after shooting up another person's car.

Thank God Florida created such a wonderful new law, otherwise I don't know what the police would have done about this....

So this new law is a re-active law not a pro-active law?

Seems like the most basic of incident to arrest search and subsequent seizure. Not sure they could've taken all the guns under that, but it gets the ball rolling.

As long as they give them back if he is acquitted, I'm okay with it. Of course, I'm sure they will be misplaced before then.

He was charged. Not convicted. It's a tool LE can use to confiscate guns from people that they convince a judge is a danger to society without having to wait until they are a convicted felon.

If someone is Baker Acted (in general, not under the new Florida Act), the police take the gun(s) the person has on them, but I don't think they go to the person's house and confiscate all of that person's guns.

The guns would not be taken in all cases. Depends on other factors. Of course they remove them from their person.

Confiscation is probably the wrong word in regards to baker act.

I guess you're right, since confiscation usually implies that they would be taking them permanently.
